Summary of Legal Challenges
The City has been engaged in two recent and notable legal challenges:
Confidential Letter of Concern from Council
Following repeated requests from Mayor Hamer-Jackson, Council authorized the release—on July 29, 2025—of a letter originally provided to the Mayor on December 22, 2022, explaining the purpose of two closed meetings held earlier that month.
Indemnification of Council Members
What is Indemnification?
Section 740 of the Local Government Act provides that a municipal council may provide for the indemnification of a municipal official to defend an action brought against them in connection with the exercise or intended exercise of the official’s powers or the performance or intended performance of the official’s duties or functions.
A “municipal official” includes:
- current or former members of Council; and
- current or former municipal officers or employees.
When Council resolves to indemnify a municipal official, this means that the City pays the costs incurred by the municipal official to defend themselves in the action brought against them, including, for example, legal fees.
