Process for Making an Offer

• Offer Instructions

  1. Offers can be submitted by email to realestate@kamloops.ca.  Alternatively, a physical copy, in the form of a Purchase Agreement or Realtor Contract can be delivered to the City, Attention: Real Estate Dept., care of 2nd floor, 105 Seymour Street, Kamloops, BC  V2C 2C6. 
      
  2. All blank fields the form of the Purchase Agreement or Realtor Contract must be completed as applicable, including signatures and initials where appropriate.
      
  3. A $10,000 deposit by way of bank draft will be required within 48 hours of the City's acceptance of an offer, payable to the buyer's lawyer or notary public. 
      
  4. The Completion, Possession and Adjustment Dates for all transactions shall be agreed upon in the form of Purchase Agreement or Realtor Contract, except as may be otherwise amended by the City after acceptance. 
      
  5. The City encourages interested buyers to consult with real estate agents and/or lawyers for assistance with the completion of offers and the review of detailed property information.  The City will, upon successful completion of a transaction, pay a buyer's agent commission of 3.0% on the first $100,000 of the accepted purchase price and 1.5% on the balance if applicable; however, all buyer legal fees will be borne by the buyer. 
      
  6. The materials and information set out on this web page, in documents linked through this web page or otherwise obtained from City representatives in relation to Royal Avenue lot sales are provided for informational purposes only and must not be relied upon without independent verification. You are urged to obtain independent review and advice from your own consultants, lawyers, real estate professionals and/or other advisors in relation to these materials and information. 
      
  7. As it is the intention of the City to obtain offers that are the most suitable and most advantageous to the interests of the City, notwithstanding anything else contained within this notice, the City reserves the right, in its sole and unfettered discretion, to reject or accept any offer, including the right to reject all offers. Without limiting the generality of the foregoing, the City may, in its sole and unfettered discretion, reject or accept any offer which:

  •  
    
    • is incomplete, obscure, irregular, unrealistic or not completed in accordance with this notice;
    • is non-compliant in a trivial/immaterial or substantial/material manner, or conditional;
    • has erasures or corrections; or
    • fails to provide the information required in the form of Purchase Agreement or Realtor Contract
       

  10. If two or more offers received by the City for the same lot are determined to be equally suitable and advantageous to the interests of the City, and the City wishes to accept one of them, the City may determine which offer to accept by way of a random draw. 
  11. The notice of proposed property disposition is an invitation to make offers only. It is not an offer. The City does not intend for this notice to create any obligations between the City and any offeror and no contractual, tort or other legal obligation of any kind is created or imposed on the City by this notice or by the submission of any offer or by consideration of, or failure or refusal to consider, any offer by the City. No contractual or other legal obligations will be created between the City and any offeror until and unless a submitted Purchase Agreement or Realtor Contract is accepted by the City. Without limiting the foregoing, the use of mandatory or prescriptive language in this notice in relation to future acts of the City is intended only to describe the City’s present intention, is not intended to express contractual intention, and if relied upon by an offeror is relied upon at that offeror’s own risk. If there is anything in this notice that is inconsistent with this paragraph, this paragraph prevails. 
  12. The City will not be responsible for any liabilities, costs, expenses, loss or damage incurred, sustained or suffered by offerors by reason of their participation in this process and/or submission of an offer for the consideration or non-consideration by the City, whether for costs, expenses, losses, damages, loss of anticipated profits or any other matter. No offeror shall have any claim for any compensation of any kind whatsoever, as a result of participating in this process and by submitting an offer, each offeror shall be deemed to have agreed that it has no claim. By submitting an offer, the offeror absolutely waives and releases any right, or cause of action against the City, its officers, directors, employees or agents by reason of the City’s failure to accept the offer submitted by the offeror, whether such right or cause of action arises in contract, negligence, bad faith or otherwise. 
  13. All documents submitted to the City will be subject to the provisions of the British Columbia Freedom of Information and Protection of Privacy Act and the City’s terms of use and privacy policy as set out at Kamloops.ca/Privacy-Policy are applicable to and form part of these instructions.

• How are the lots serviced and zoned?

  Each lot has municipal services installed at the property line. Purchasers are responsible for third party utilities and are encouraged to undertake a BC 1 Call at 1-800-474-6886 prior to any construction.

  The lots are zoned R1 (Residential 1), which permits the following principal uses: 

  • Single-Detached Residential

  • Single-Detached Residential with Residential Suite

  • Two-Unit Residential

  • Small-Scale Multi-Unit Residential limited to:

    • Single-Detached Residential with Residential Suites

    • Single-Detached Residential Buildings with or without Residential Suites

    • Two-Unit Residential Buildings

    • Two-Unit Residential Buildings with Residential Suite(s)

    • Three-Unit Building with or without a Garden or Carriage Suite

    • Four-Unit Building

  Accessory uses under R1 (Residential 1) zoning include: 

  • Home-Based Business, subject to Division 3, Section 3.3

  • In the case of Single-Detached Residential, Single-Detached Residential with Residential Suite, and Two-Unit Residential uses:

    • Boarders or Lodgers to a maximum of two Persons

  • In the case of Single-Detached Residential uses: 

    • Daycare, Home-Based

    • Residential Care Facility, Licensed Home-Based

  Please refer to the City's Zoning Bylaw for use and development regulations and requirements. 

   

• How do real estate agent commissions work in relation to these properties?

  A buyer's agent commission of 3.0% on the first $100,000 and 1.5% on the purchase price balance will, upon successful completion of a transaction, be paid to the licensed agent's real estate brokerage. 

• What is the Dike and Drainage Statutory Right-of-Way (SRW)?

  The lots are located behind a dike which is constructed to the 1:20 year flood level. The SRW gives the City the right to access and maintain that portion of the dike that is located on the lots. You cannot construct any structures within the area of the SRW, which is shown on Plan EPP93067.

• What is the Riparian Protection Covenant?

  A riparian area is a zone of land adjacent to a body of water. Development restrictions within the zone are found within a riparian area assessment report. No structures are allowed to be placed or constructed within the riparian area. The extent of the riparian zone on the lots is shown on plan EPP93068. The full Riparian Areas Regulation - Assessment Report is attached to the Riparian Protection Covenant.  For your individual lot planning, you may want to consult a Qualified Environmental Professional (QEP) to discuss Riparian Area Regulations and lot information.

• What is the Flood Plain Covenant?

  The lots are within the 1:200-year flood plain. They are located behind a dike which is constructed to the 1:20-year flood level. The Flood Plain Covenant prohibits construction within 15m of the river, requires the underside of the floor system to be no lower than 346.6m and sets the maximum crawl space ceiling height at 1.8m (full basements are not allowed). The lots have been graded to accommodate construction to the 346.6m elevation, however additional site fill may be needed.

• What is the Driveway Access and Grading/Drainage Covenant?

  Construction on any lot is subject to the City's approval of a lot-specific grading and drainage plan, and the use of any lot must also be in compliance with the grading plan attached to the Driveway Access and Grading/Drainage Covenant. 

  Lot 1 ONLY - BC Hydro utility poles are located on Royal Avenue, with one pole being offset 5.19m from the northwest corner of Lot 1. The driveway location for Lot 1 must be established to the east of the hydro pole in accordance with the measurements and requirements of the registered Driveway Access and Grading/Drainage Covenant.
